Cuba Envios operates as a company incorporated in the State of Florida, United States, with three company-owned offices in Florida and a delivery network on the island that performs delivery at destination. This page explains the framework applicable to the operation and the points that remain to be confirmed.
1. Scope of the regulatory framework
The operation takes place on two levels: the law of the State of Florida and of the country of origin of each shipment — the United States — and the law of the destination country. The three Florida offices apply the same corporate framework, and the delivery network on the island works under the operation's direction.
The specific reference titles applicable to each type of operation are not yet finalized and are documented in Pending completion by legal counsel. Until they are confirmed, no statement on this site should be understood as authorization to ship any particular goods.
2. Law of the country of origin and destination
Before accepting a shipment, the operation verifies that the goods and their documentation can move along the chosen route. That check includes applicable import and export restrictions and the documentation requirements imposed by the destination.
The specific framework is identified in Pending completion by legal counsel. The operation keeps that reference up to date because requirements change frequently and each destination has different requirements.
3. Declaration of contents and customs
The declaration of contents is signed by the sender and is the basis for the customs procedure. If the information does not match what is traveling, the operation cannot guarantee either the departure of the goods or their delivery at destination.
Valuation criteria, the documentation accompanying each type of cargo, and the procedure followed in the event of a hold are described in Pending completion by legal counsel.
4. Data protection
The controller of customer data is the company itself, with a legal basis determined for each purpose and the service channels published on this site. Infrastructure providers and the delivery network on the island act as processors or controllers depending on their role in each case.
The specific obligations assumed by each party and the framework for international transfers are set out in Pending completion by legal counsel.
5. Anti-money laundering
The operation applies identification and verification controls to the transactions that sector regulations require it to identify, and establishes escalation steps when a transaction shows risk indicators.
The specific procedure, with its review and internal reporting levels, will be documented in Pending completion by legal counsel and in Pending completion by legal counsel.
6. Billing and taxation
The operation issues its documents with the tax data required by its territory and is responsible for settling the taxes applicable to it.
The tax rates applicable to each service and each route, as well as the basis for taxability in operations involving more than one office or a third party at destination, are documented in Pending completion by legal counsel.
7. Records and document retention
The operation retains the documentation of each shipment for the period required by applicable law, in order to be able to evidence the nature of the goods, their value, and their route.
The details of what is retained, in what format, and for how long are established in Pending completion by legal counsel.
8. Sanctions regime
The operation is liable for violations attributed to it under the law of the State of Florida and any other applicable law, before the authorities with jurisdiction in each territory. The difference between territories is part of the risk assumed by anyone who contracts a shipment with Cuba Envios.
Contacts and the procedure for notifying case files are detailed in Pending completion by legal counsel.
